Terms of Service
Please read these terms carefully before using JMLogMarket.

1. What JMLogMarket Is
JMLogMarket is operated by JMLOGMARKET LLC ("we," "us," or "the Platform"), a Kentucky limited liability company. JMLogMarket is an online marketplace that connects people who have logs, lumber, or mill products to sell with people who want to buy them. We also list trucking and timber services.
We are a listing platform only. We do not buy logs. We do not sell logs. We do not arrange or guarantee any transaction. We simply provide a place for buyers and sellers to find each other.
2. We Are Not Part of Your Deals
When you contact a seller or buyer through JMLogMarket, you are dealing directly with that person or business. JMLogMarket is not a party to any transaction, agreement, or contract you make with another user.
This means:
- We do not verify the accuracy of listings (species, volume, grade, price, etc.)
- We do not inspect logs, lumber, or equipment
- We do not guarantee that sellers will deliver what they promise
- We do not guarantee that buyers will pay
- We do not mediate disputes between users
- We do not hold funds or provide escrow services
You are responsible for your own due diligence. Inspect products before buying. Verify the other party. Get agreements in writing. Use your own judgment.
3. User Accounts
To post listings, you must create an account. By creating an account, you agree that:
- You are at least 18 years old
- The information you provide is accurate
- You will keep your login credentials secure
- You are responsible for all activity under your account
- You will notify us immediately if you suspect unauthorized access
We may suspend or terminate accounts at our discretion, with or without notice, for any reason including violation of these terms.
4. Listing Rules
When you post a listing on JMLogMarket, you agree that:
- You have the legal right to sell what you're listing
- Your listing is accurate and not misleading
- You will respond to inquiries in good faith
- You will not post illegal, stolen, or fraudulent items
- You will not post spam, duplicate listings, or off-topic content
- You will not use the platform to harass other users
We reserve the right to remove any listing at any time for any reason, without notice.
5. Fees & Billing
JMLogMarket offers a free tier that allows limited listings at no cost. Paid subscription plans are available for sellers who need more listings. Service provider directory listings require a monthly subscription. All paid plans are billed monthly and can be canceled at any time. On our website and our Android app, payments are processed by Stripe. On our iPhone (iOS) app, subscriptions are purchased and processed by Apple through In-App Purchase rather than Stripe — see Section 6 for how iOS billing, renewal, and cancellation work.
We do not take commissions on sales between buyers and sellers. Subscription fees are for platform access and listing privileges only.
We reserve the right to change pricing at any time. If we do, existing subscribers will be notified in advance and any price changes will only apply at the next billing cycle.
6. Auto-Renewal & Cancellation
All paid subscriptions automatically renew at the end of each billing period (monthly) at the then-current rate unless you cancel before the renewal date.
How auto-renewal works:
- Your subscription will automatically renew each month on the same date you originally subscribed
- Your payment method on file will be charged automatically at renewal
- You will receive an email receipt from Stripe for each charge
- The renewal price will be the same as your current plan rate unless we notify you of a price change in advance
How to cancel:
- Seller plans (web & Android): Log in to your account, go to your Account page, and click "Manage Plan" to open the Stripe billing portal where you can cancel. (iOS subscriptions are canceled through Apple — see below.)
- Service provider listings: Use the "Manage Subscription" link in any Stripe receipt email to cancel

When you cancel, your subscription remains active through the end of your current paid billing period. After that period ends, your account reverts to the free tier and any listings beyond the free limit will no longer be displayed.
Subscriptions purchased through the iPhone (iOS) app. If you subscribe inside our iOS app, your subscription is sold and billed by Apple through In-App Purchase, and Apple is the merchant of record. These subscriptions automatically renew through your Apple ID at the then-current rate unless auto-renew is turned off at least 24 hours before the end of the current period. To manage or cancel an Apple subscription, open the iPhone Settings app, tap your name at the top, tap Subscriptions, select JMLogMarket, and cancel there — Apple subscriptions cannot be canceled through the Stripe billing portal or your Account page. Cancellation takes effect at the end of the current billing period.
7. Refund Policy
Subscriptions are non-refundable. When you cancel, you retain access to your paid plan through the end of your current billing period, but no partial or prorated refunds will be issued for unused time.
Exceptions:
- If you are charged in error (e.g., duplicate charge or charge after cancellation), contact us and we will issue a full refund for the erroneous charge
- If you experience a significant platform outage that prevents you from using your paid features for an extended period, contact us and we will evaluate a credit or refund on a case-by-case basis
To request a refund for an eligible situation, contact us at Jett@jmlogmarket.io within 30 days of the charge.
iPhone (iOS) purchases. Because Apple is the merchant of record for subscriptions purchased through the iOS app, refund requests for those purchases are handled by Apple, not by us. Request an iOS refund at reportaproblem.apple.com. We cannot issue refunds for purchases made through Apple In-App Purchase.
8. Limitation of Liability
To the maximum extent permitted by law, JMLOGMARKET LLC is not liable for any damages arising from your use of the platform or any transaction with another user.
This includes but is not limited to:
- Loss of money due to a bad deal
- Products that don't match their description
- Non-delivery of products
- Non-payment by buyers
- Injury, property damage, or other harm
- Loss of data or account access
- Any indirect, incidental, or consequential damages
9. Disclaimer of Warranties
The platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory.
JMLOGMARKET LLC specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that:
- The platform will be uninterrupted, timely, secure, or error-free
- The information, listings, or content on the platform are accurate, reliable, or complete
- Any particular listing accurately represents the species, grade, volume, or condition of the timber, logs, lumber, or other products described
- Any transaction between users will be completed successfully
- The platform will meet your specific requirements
You use the platform and rely on any information at your own risk. Always inspect products in person before purchasing and verify claims independently.
10. Indemnification
You agree to indemnify and hold harmless JMLOGMARKET LLC, its members, owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the platform
- Your listings or content
- Your transactions with other users
- Your violation of these terms
- Your violation of any law or third-party rights
11. Intellectual Property
The JMLogMarket name, logo, and website design are our property. You may not copy, modify, or use our branding without permission.
When you post content (listings, photos, descriptions), you retain ownership but grant us a license to display, distribute, and promote that content on the platform.
12. Third-Party Services
JMLogMarket uses third-party services for authentication, hosting, payment processing, and other functions. Your use of the platform is also subject to the terms of these providers, including but not limited to Amazon Web Services (AWS), AWS Cognito, Stripe (website and Android payments), Apple (iOS In-App Purchase and App Store distribution), and RevenueCat (which manages iOS subscription entitlements). 13. Changes to These Terms
We may update these terms from time to time. When we make significant changes, we will update the "Last Updated" date at the top of this page.
Continued use of the platform after changes take effect constitutes acceptance of the new terms.
14. Dispute Resolution & Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Informal Resolution First. Before filing any formal claim, you agree to contact us at Jett@jmlogmarket.io and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved this way.
Binding Arbitration. If we cannot resolve the dispute informally, you and JMLOGMARKET LLC agree to resolve any claims relating to these Terms or the platform through final and binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Greenup County, Kentucky, or at another mutually agreed location. You may also choose to participate by phone or video conference.
No Class Actions. You and JMLOGMARKET LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive the right to a jury trial.
Exceptions. Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to Jett@jmlogmarket.io within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration clause. If you opt out, the Governing Law section below will apply to any disputes.
15. Governing Law
These terms are governed by the laws of the Commonwealth of Kentucky, United States. To the extent that litigation is permitted under these Terms (including if you opt out of arbitration), any disputes will be resolved in the courts of Greenup County, Kentucky.
16. Severability
If any part of these terms is found to be unenforceable, the remaining parts will continue in full force and effect.
17. AI Grading Tools — Estimates Only
JMLogMarket offers free AI-powered tools (the AI Log Grader and AI Tree Grader) that produce automated estimates of timber grade and value. These tools apply USDA Forest Service grading methodology (NE-1 hardwood log grading, NE-333 hardwood tree grading, Agriculture Handbook 678 defect catalog) to photos you upload and return a structured grade plus a $-value range based on Kentucky Division of Forestry quarterly delivered-log pricing data.
By using these tools, you acknowledge and agree:
- Grades and values produced by these tools are ESTIMATES, not professional appraisals. They are intended for educational and orientation purposes only.
- Grades are not a guarantee of buyer acceptance. A professional grader, scaler, or buyer may grade the same log or tree differently. Always confirm with a qualified human grader, forester, or buyer before agreeing to a sale price.
- The 5-year value projection in the AI Tree Grader is a forward-looking statement based on simplified assumptions (approximately 0.3 in/yr DBH growth and 2%/yr nominal price growth). Actual future value depends on market conditions, stand quality, weather, pests, and other factors we cannot predict. These projections are NOT financial or investment advice.
- No fiduciary relationship. Using the AI graders does not create a forester-client, broker-client, advisor-client, fiduciary, or any other professional relationship between you and JMLogMarket LLC.
- No liability for decisions made based on grader output. JMLOGMARKET LLC, its members, owners, employees, contractors, and affiliates are not liable for any financial loss, missed opportunity, contract dispute, valuation error, or harvest decision you make based on a grader output. The disclaimers in §8 (Limitation of Liability) and §9 (Disclaimer of Warranties) apply in full.
- Photo processing. Photos you upload to the AI graders are sent to Anthropic (the Claude vision API) for defect detection. Under Anthropic's commercial API terms in effect, customer inputs such as your photos are not used to train Anthropic's models and are not retained beyond what those terms permit. We do not control Anthropic's practices, and those terms may change. See our Privacy Policy §4 for details.
If you are making a meaningful financial decision (selling timber, signing a logger contract, valuing an estate or property), retain a state-licensed professional forester, consulting forester, or certified appraiser.
18. Apple App Store & Apple EULA
If you download or use the JMLogMarket app from the Apple App Store, you also agree to Apple's standard Licensed Application End User License Agreement (the "Apple EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. To the extent the Apple EULA conflicts with these Terms with respect to your use of the iOS app, the Apple EULA governs that conflict.
You acknowledge that these Terms are between you and JMLOGMARKET LLC only, and not with Apple. Apple is not responsible for the JMLogMarket app or its content. Apple has no obligation to provide any maintenance or support for the app, and is not responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, or claims arising under consumer-protection or similar law. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
19. Force Majeure
JMLOGMARKET LLC is not liable for any delay or failure to perform, or for any interruption of the platform, caused by events beyond our reasonable control. These include, but are not limited to, outages or failures of third-party hosting, network, payment, or cloud providers; internet or telecommunications failures; power outages; natural disasters, fire, flood, or severe weather; epidemics or pandemics; labor disputes; acts of war, terrorism, or civil unrest; and acts, orders, or restrictions of any government or regulatory authority. If such an event prevents you from using paid features for an extended period, your sole remedy is the discretionary, case-by-case credit or refund described in Section 7.
20. Acceptable Use
To keep the platform safe and available for everyone, you agree that you will not, and will not permit any other person or automated system acting on your behalf to:
- Scrape, crawl, harvest, or otherwise collect listings, seller or buyer contact information, or other content from the platform using any automated means, except as expressly permitted in writing by us
- Probe, scan, or test the vulnerability of the platform or any related system, or breach or circumvent any security, authentication, or rate-limiting measure
- Reverse engineer, decompile, or disassemble any part of the platform, except to the limited extent that applicable law prohibits this restriction
- Abuse the AI Log Grader or AI Tree Grader, including by submitting bulk or automated queries, attempting to extract the underlying rule engine or pricing data, or using the tools for any purpose other than evaluating your own logs or trees
- Use the platform in any way that imposes an unreasonable or disproportionately large load on our infrastructure, or that interferes with the proper working of the platform
Violation of this section is a violation of these Terms, and we may suspend or terminate your account and access under Section 3, in addition to any other remedies available to us.
